These Terms and Conditions ("Terms") govern your use of the OrderNotebook application and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Your account

  • You must be at least 16 years old to use the Service.
  • You are responsible for keeping your password and devices secure. Anyone with your password can access your data.
  • One account is for one shop owner. You may use it on multiple devices, but you may not share credentials with people outside your business.
  • You agree to provide a real, working email address. A typo in your email creates a separate account; we cannot recover data placed under a misspelt address.

2. Acceptable use

You agree not to:

  • Use the Service for anything illegal, fraudulent, or that violates the rights of others.
  • Store content that is unlawful, abusive, defamatory, or that you do not have permission to store (including customer data collected without their consent).
  • Upload images that are illegal, obscene, infringe copyright, or contain malware.
  • Reverse-engineer, scrape, or attempt to bypass rate limits or authentication.
  • Use the Service to send spam or unsolicited communications.
  • Interfere with or disrupt the Service, its infrastructure, or other users.

We may suspend or terminate accounts that violate these rules, with or without notice.

3. Your content and data

  • You retain ownership of every product, customer, order, and image you enter into OrderNotebook.
  • You grant us a limited licence to store, process, transmit, and display your content solely to operate the Service for you.
  • You are responsible for the accuracy of the data you enter, including prices, totals, and customer information.
  • You are responsible for complying with privacy and consumer-protection laws in your jurisdiction when collecting and using customer data through the Service.

4. Service availability

  • The Service is provided on a best-effort basis. We aim for high availability but do not guarantee uninterrupted, error-free operation.
  • The app is designed to work offline; transient connectivity issues should not block your day-to-day work.
  • Maintenance windows, third-party outages, or unexpected incidents may cause temporary unavailability.

5. Backups and data loss

  • We take reasonable measures to protect against data loss, but you should not rely on the Service as your only record of business-critical information.
  • Soft-deleted items remain recoverable for a limited window. Hard-deleted or expired data cannot be restored.
  • We are not liable for loss of data caused by your own actions (deleting records, deleting your account, losing your device or password).

6. Pricing and payments

If and when paid plans are introduced, pricing, billing terms, and refund policies will be presented to you in-app before you subscribe. Until then, the Service is provided free of charge during early access. We reserve the right to change pricing on reasonable notice; continued use after a change indicates acceptance.

7. Termination

  • You may delete your account at any time using the Delete my account action in the app.
  • We may suspend or terminate your account if you violate these Terms, abuse the Service, or if required by law.
  • On termination, your access to the Service ends. Soft-deleted data is purged in due course according to our retention practices.

8. Disclaimer of warranties

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your specific business needs or be free from errors.

9. Indemnity

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising out of (a) your violation of these Terms, (b) your misuse of the Service, or (c) your collection or handling of customer data through the Service.

10. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top will reflect the current version. Material changes will be announced in the app. Continued use of the Service after changes take effect indicates acceptance.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which OrderNotebook's operating entity is registered, without regard to conflict-of-laws rules. Disputes shall be resolved in the courts of that jurisdiction.
